Terms & Conditions: 2025 "I Built It Smarter" Photo Competition

1. Promoter Details

The promoter of this Competition is Smartkits Australia Pty Ltd (ABN 84 139 101 858), part of the QHI Group, located at 7 Londor Close, Hemmant, QLD, 4174.

2. Agreement to Terms & Conditions

Each entry must be submitted in accordance with these Terms & Conditions. By entering the Competition, entrants agree to be bound by these Terms & Conditions. The Promoter may, at its discretion, refuse to award any prize to entrants who fail to comply with these Terms & Conditions.

3. Entry Period & Deadlines

Competition Entry Period: 1st March 2025 – 30th June 2025
Voting Period: 1st July 2025 – 31st August 2025
Top 20 Finalists Announcement: 1st September 2025
Winners Announcement: 3rd October 2025

4. Eligibility

The Competition is only open to legal residents of Australia who are aged 18 years or older. Entrants aged 16-17 may enter with written parental or guardian consent.
The entrant must have purchased a kit from Smartkits Australia Pty Ltd.
Each kit can only be entered once into the competition.
Previous entries from past 'I Built It Smarter' competitions cannot be resubmitted.
Repeat customers may enter new structures that have not been entered in prior competitions.
Only the best 150 entries will be accepted into the 2025 Competition. Submission of an entry form does not guarantee participation.

5. Entry Requirements

To be eligible, each entry must include:
1. Four (4) landscape photos of the completed structure.
2. A minimum 25-word product review about the Smartkits experience.
Failure to meet these requirements will result in disqualification.

6. Grant of Rights & Intellectual Property

By submitting photos, entrants grant the Promoter a non-exclusive, royalty-free, worldwide, and perpetual license to use, reproduce, and publish their photos for marketing, promotional, and publicity purposes across any media platform.
Entrants warrant that:
- The submitted photos are their own original work and do not infringe on third-party rights.
- They own the copyright or have legal permission to submit the photos.
- Any individuals appearing in the photos have consented to their image being used.
The Promoter is not liable for copyright disputes arising from the use of submitted content.

7. Judging & Voting

The Top 20 finalists will be selected as follows:
- The Top 10 entries with the most public votes will be automatically included in the Top 20.
- The remaining 10 entries will be selected by a panel of industry professionals after the voting period concludes.
Chance plays no part in determining the winners.
The final winners will be chosen based on how well their entry encapsulates the 'I Built It Smarter' theme.
Any fraudulent voting activity (e.g., bots, multiple fake accounts, automated scripts) will result in disqualification.

8. Prize Pool ($100,000 Total)

1st, 2nd & 3rd prizes and supplementary prizes amounts will be confirmed before the entry period closes.

9. Winner Notification & Prize Collection

Winners will be announced on 3rd October 2025 via Smartkits' official channels.
Winners must provide valid identification and proof of purchase before receiving their prize.
All cash prizes will be paid via bank transfer within 30 days of the announcement.
Winners are responsible for any applicable taxes associated with their prize.

10. Fraud & Disqualification

The Promoter reserves the right to disqualify any entry that:
- Contains false or misleading information.
- Uses AI-generated or manipulated images.
- Engages in vote manipulation or fraudulent activity.
- Fails to meet the eligibility and entry requirements.
If fraud is discovered after a prize has been awarded, the Promoter reserves the right to revoke the prize and reclaim awarded funds.

11. Privacy & Data Protection

Personal data collected for this competition will not be shared with third parties except as required by law.
Entrants agree that their submitted photos and names may be used in promotional materials without compensation.

12. Liability & Technical Issues

The Promoter is not responsible for:
- Lost, late, or misdirected entries due to internet or technical failures.
- Damage or loss of prizes in transit.
- Errors or inaccuracies in any published competition information.
If unforeseen circumstances prevent the competition from running, the Promoter may cancel or reschedule it at its discretion.

13. Unclaimed Prizes

If a winner cannot be contacted or does not claim their prize within six (6) months, the Promoter may select another winner.

14. Dispute Resolution

Any disputes or complaints will be handled through mediation first, before legal action is pursued.
Entrants waive legal claims against the Promoter related to competition results, photo usage, or disqualification.

15. Required Permits
